Terms of service

These terms cover your use of Perwear. Please read clause 3 and clause 12 particularly: the first sets out what this service refuses to do, and the second confirms that nothing here reduces the rights the law gives you.

1Who these terms are between

1.1

These terms are an agreement between you and the company that operates Perwear. The company’s registered particulars and contact details are published on the legal information page.

1.2

By creating an account or using the service you accept these terms. If you do not accept them, do not use the service.

1.3

You must be at least 18 years old. The service is not directed at children and accounts are not knowingly provided to anyone under 18.

2What the service does

2.1

Perwear estimates the cost per wear of garments. It reads four properties from photographs you supply — fibre composition, whether the heel and toe are reinforced, how the toe seam is finished, and how tightly the fabric is knitted — and applies a published table of coefficients to produce an estimated range of wears. It then divides the price you have entered by that range.

2.2

The estimate of wears and every figure derived from it is produced in your browser from that table. The machine-learning model is used for one purpose only: identifying those four properties in an image. It does not estimate a number of wears and it does not calculate any monetary figure.

2.3

Each comparison returns, at minimum:

  • an estimated range of wears for each pair;
  • a cost per wear for each pair, expressed as a range;
  • an account of what the more expensive construction is buying, itemised against the properties observed;
  • the wear at which the dearer option breaks even on cumulative spend, where one exists;
  • the circumstances in which the cheaper option is the better buy; and
  • a statement of what the estimate cannot know.
2.4

The last two of those are always produced and are never withheld, watermarked over, or restricted to a paid plan.

3What the service does not do

3.1

This is a calculation tool. It does not:

  • hold, look up, store, publish or suggest any market price, price range or price expectation for any product;
  • provide price comparison, price tracking, retailer information, availability information or any route to purchase anything;
  • evaluate, rate, rank, endorse or name any brand, manufacturer or retailer;
  • recommend that you buy anything, or advise which option to choose;
  • sell socks or any other physical goods; or
  • provide investment, financial, tax or any other regulated advice.
3.2

Every price the service handles is a figure you have typed in yourself. Names read from a photographed label are redacted before they can be displayed, exported or shared.

On the estimate itself

The number of wears is an estimate, not a promise. It is given as a range and should be treated as one. How you launder a garment — tumble drying above all — how hard you wear it, the condition of your footwear, and whether a pair is lost or retired before it wears out all change the outcome materially, and none of them can be seen in a photograph.

The more expensive option is not always the better value. Where wearing frequency is low, loss risk is high, or conditions are severe, the cheaper option may remain the better buy, and the service will say so.

4Your account

4.1

Keep your sign-in details to yourself. You are responsible for activity carried out through your account. Tell us promptly if you think someone else has access to it.

4.2

You may close your account at any time from the account area. Closing an account deletes your comparisons and uploaded photographs on the schedule set out in the privacy policy.

5Subscriptions and payment

5.1

There are three plans: Free, Mileage, Ledger. The paid plans cost $8.00 USD a month or $77.00 USD a year for Mileage, and $24.00 USD a month or $230.00 USD a year for Ledger. All prices are in USD and are including VAT at 20%.

5.2

Payment is taken at the start of each billing period. The full price, the billing period, the fact that the subscription renews automatically, and the route to cancel are all shown on the checkout page before you commit.

5.3

Card details are entered into, and held by, a PCI DSS Level 1 certified payment processor. They are not transmitted to or stored on our own systems. The site is served over HTTPS throughout.

5.4

There are no promotional offers, discounts, trials or introductory rates in operation. If any are introduced, their conditions will be stated in full at the point you are asked to accept them.

5.5

If a payment fails we will try again and tell you. If it cannot be taken, the subscription moves to the free plan rather than accruing a debt.

6Allowances

6.1

Each plan includes a monthly allowance of service units. Units are consumed by using the service: one unit for a question answered, two units for reading the construction of one pair from photographs, and five units for rendering a comparison and break-even chart.

What an allowance is, and is not

An allowance is a permission to use the service for the period you have paid for. It is not money, is not stored value, has no cash value, is not redeemable for cash, and is not transferable to another person or another account.

Unused allowance does not carry over to the next period. There are no credit packs, no top-ups and no stored balances of any kind. If you need more capacity in a period, the only route is to move to a higher plan.

6.2

We will not reduce the allowance included in your plan during a period you have already paid for.

7Renewal, reminders and exit

7.1

Subscriptions renew automatically at the end of each period until cancelled, at the price then published for your plan. You are told the renewal date and the amount before you subscribe, and again in your confirmation email.

Early implementation of the DMCCA 2024 subscription rules

The Digital Markets, Competition and Consumers Act 2024 introduces new subscription requirements which are expected to come into force in spring 2027. We have chosen to implement them now rather than wait. This clause therefore goes beyond what the law currently requires of us.

The five commitments are:

  • Pre-contract information screen — the full price, the billing period, the renewal date and the cancellation route are shown together on one screen immediately before you commit.
  • A standalone renewal reminder — sent as its own email before each renewal, containing only the renewal information. It is never bundled into a marketing message and you cannot unsubscribe from it while you hold a subscription.
  • An initial 14-day cooling-off period from the day the contract is made.
  • A further 14-day cooling-off period beginning again after each renewal.
  • Easy exit — cancellation is a single action inside your account, with no retention offer, no confirmation maze and no obligation to contact anyone.
7.2

Cancelling stops the next renewal. Your plan continues until the end of the period you have already paid for, and then reverts to the free plan.

8Cancellation and refunds

8.1

You have a statutory right to cancel within 14 days of the contract being made, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The full procedure, the two acknowledgements you are asked to give at checkout, and the statutory model cancellation form are on the cancellation and refunds page.

8.2

Where you ask for the service to start immediately within that 14-day period, and it is then fully performed within it, the cancellation right for that period ends. We ask you to acknowledge that separately, in a box that is not pre-ticked, and we repeat both acknowledgements in your order confirmation email as a durable record.

8.3

Beyond that statutory right, if the service has not worked as described we will put it right or refund you. Write to support@corgihosiery.shop.

9Your content

9.1

You keep ownership of the photographs and figures you upload. You give us only the permission needed to run the service for you: to store your uploads, process them to identify the four construction properties, and show you the result.

Your uploads are not used to train models

Photographs, prices and comparisons you supply are not used to train, fine-tune, evaluate or benchmark any machine-learning model, ours or a third party’s.

Photographs are retained for up to 30 days so that you can return to a comparison, and are then deleted. Deleting a comparison deletes its photographs immediately. Closing your account deletes everything within 30 days. The detail is in the privacy policy.

9.2

Do not upload photographs of other people, or anything you do not have the right to upload.

10Acceptable use

10.1

The acceptable use policy forms part of these terms. It lists the high-risk purposes for which output from this service must not be used, and the conduct that will lead to an account being suspended.

10.2

If we suspend or close an account for a breach we will tell you why, and you may respond. Where we close a paid account for a breach, we refund the unused part of the current period.

11Availability and changes

11.1

We aim to keep the service available and working correctly. Maintenance is announced in advance where it is planned.

11.2

We may improve the coefficient table, the interface and the feature set. Where a change materially reduces what your plan includes, we will tell you at least 30 days beforehand and you may cancel and take a refund of the unused part of your period.

11.3

We may change these terms. Material changes are notified by email at least 30 days before they take effect, and you may cancel before then without penalty.

12Your statutory rights

This clause takes precedence over everything else in these terms

Nothing in these terms affects your statutory rights.

Under the Consumer Rights Act 2015 digital content supplied to a consumer must be of satisfactory quality, fit for any purpose made known to the trader, and as described. Those rights cannot be excluded or restricted, and section 47 of that Act makes any attempt to do so ineffective. Nothing here is intended to have that effect, and if any clause would, it does not apply to that extent.

You also keep every right given to you by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and by any other consumer protection legislation applying to you.

13Our responsibility to you

13.1

We are responsible for loss you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable.

13.2

We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, and for any breach of your rights under the Consumer Rights Act 2015.

13.3

The service produces estimates within stated ranges. You should treat the output as one input to a decision that remains yours, and not as a guarantee of how long any garment will last. Where the service is used for a purpose it is not fit for — including any of the high-risk purposes listed in the acceptable use policy — we are not responsible for the consequences of that use.

13.4

Except where clause 13.2 applies, our total liability arising out of or in connection with this contract in any 12-month period is limited to the greater of the amount you paid us in that period and $50.00 USD.

14Law, disputes and complaints

14.1

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts, and if you live outside the United Kingdom you keep the benefit of any mandatory consumer protection that applies where you live.

14.2

Complaints are handled directly by us. Write to support@corgihosiery.shop or call +44 1269 590920. We acknowledge complaints within one working day and aim to resolve them within ten. The escalation route is set out on the support page.

14.3

We are not a member of any alternative dispute resolution scheme, and there is no general obligation in the United Kingdom on a trader to join one. If we cannot resolve a complaint between us, you remain free to take the matter to court.

14.4

If any part of these terms is found to be unenforceable, the rest continues to apply.
